THE Court of Appeals has ordered the Armed Forces and the PNP to produce in person missing Cordillera activists Dexter Capuyan and Gene Roz Jamil De Jesus.
This after the appellate court’s Thirteenth Division, in a July 10 resolution, found the petition for writ of habeas corpus lodged by the relatives of Capuyan and De Jesus sufficient in form and substance.
A writ of habeas corpus is an order to present a person before the court to determine if the arrest and detention is legal or if a person must be released from custody or detention.
In its resolution, the appellate court directed the respondents — AFP Chief of Staff Lt. Gen. Andres Centino, PNP Chief Gen. Benjamin Acorda, Rizal Police Provincial Director Col. Dominic Baccay, and PNP-CIDG Chief Brig. Gen. Romeo Caramat — to “appear before this Court and produce and bring the bodies and persons” of the two missing activists today, July 14.
